Terms of Service

Effective 8 August 2026 · Applies to join.taparcana.com and to the AI Jewelry Assistant on WhatsApp and Telegram.

1. Acceptance

These Terms of Service ("Terms") are a binding agreement between you and Tap Arcana ("we", "us", "our") governing your use of the AI Jewelry Assistant and the signup site at join.taparcana.com (together, the "Service").

You accept these Terms by requesting an access key, by redeeming a key, or by using the bot. If you do not accept them, do not use the Service. You must be at least 18 years old, and if you are using the Service on behalf of a business you confirm you are authorised to bind it.

2. The Service

The Service is an AI assistant delivered through WhatsApp and Telegram that can:

• generate images of jewelry designs from a description;
• place a photographed piece of jewelry onto a model image ("try-on");
• read specifications from a photograph and produce an indicative price estimate using live metal rates and margins you configure;
• store your pricing configuration.

WhatsApp and Telegram are third-party platforms. Your use of them is governed by their own terms, and their availability, reliability and feature support are outside our control.

3. Access keys

• A key is issued to you personally and may be bound to a limited number of chat accounts — currently up to two, typically one WhatsApp and one Telegram.
• Keys are shown once, at signup. We cannot retrieve a lost key; you would need to request a new one from the signup page.
• You are responsible for keeping your key confidential and for all activity carried out with it. Do not share, sell or publish it.
• Creating multiple keys to evade limits, bans or rate limits is a breach of these Terms.
• If your key is compromised, stop using it and request a new one. We do not operate a channel for reporting it.

4. Our right to revoke access

Access to the Service is at our discretion. We may suspend, revoke, expire or refuse any access key at any time, for any reason or for no reason, with or without notice, and without liability. Access is a revocable permission, not a right, and it is not transferable.

Reasons may include, without limitation:

• breach or suspected breach of these Terms;
• sharing a key, or creating multiple keys;
• usage that imposes disproportionate cost or load on the Service;
• content that is unlawful, abusive, or harmful to others;
• protecting the Service, our other users, or ourselves;
• discontinuing the Service, a feature, or free access generally.

A revoked key stops working immediately on all channels. Revocation does not delete data already collected, which we retain as described in the Privacy Policy. There is no appeal process, and we are not obliged to tell you the reason for a revocation.

5. Acceptable use

You agree not to:

• use the Service unlawfully, or to produce content that is illegal, defamatory, hateful, harassing, sexually explicit, or that depicts minors inappropriately;
• upload photographs of people without their informed consent (see section 6);
• upload content you do not have the rights to, or that infringes anyone's intellectual property, publicity or privacy rights;
• attempt to generate counterfeit goods, forged hallmarks, or images intended to deceive buyers about the authenticity, origin or composition of an item;
• probe, scan, overload, scrape or reverse-engineer the Service, or attempt to bypass access controls, rate limits or the access key system;
• automate or resell access to the Service, or use it to build a competing product;
• submit content designed to manipulate the underlying AI models into ignoring these Terms or their safety behaviour;
• impersonate another person or misrepresent your affiliation with anyone.

6. Photos of people

The try-on feature accepts a photo of a model, and you may supply your own. If you do, you confirm that:

• the person is an adult;
• they have given informed consent to their image being uploaded, stored by us indefinitely, reviewed by our team, processed by our AI provider, and altered to depict them wearing jewelry; and
• you have the right to grant us the licence in section 8 for that image.

Never upload a photograph of a child. You are solely responsible for the images you upload and for the consents behind them. Bear in mind that an uploaded photo cannot afterwards be removed (section 9), so the consent you obtain must cover permanent retention. Built-in model photos are provided so that supplying photos of real people is never necessary.

7. Price estimates are not quotes

The price estimation feature produces an indicative estimate only. It infers metal, weight and stone details from a photograph using an AI model, applies third-party metal rates that may be cached or out of date, and multiplies through the margins you configured. It cannot weigh a piece, assay a metal, grade a stone, or verify a hallmark.

Estimates are not appraisals, valuations, offers, or quotations, and must not be relied upon for buying, selling, insuring, lending against, or declaring the value of any item. Verify independently before you transact. You are responsible for any price you quote to your own customers, and we accept no liability for losses arising from reliance on an estimate.

8. Your content and generated output

Your content. You keep ownership of the messages and images you send. You grant us a worldwide, non-exclusive, royalty-free, perpetual and irrevocable licence to host, store, reproduce, transmit to our AI provider, modify (as needed to produce the results you asked for), and display that content to our team, for the purposes of operating, supporting, securing and improving the Service.

Generated output. Subject to these Terms and our AI provider's terms, you may use the images the bot generates for you, including commercially. Be aware that:

• AI output may be similar to output generated for someone else, and we make no claim of exclusivity;
• copyright in AI-generated material is unsettled in many jurisdictions and we make no representation that you own or can register it;
• output can be inaccurate — a generated image may not be manufacturable and may not match any real piece;
• you must not present generated images as photographs of goods you actually hold, or in any way that misleads a buyer.

We may use conversation and generation data internally to improve the Service, as described in the Privacy Policy.

9. Data collection and monitoring

You acknowledge and agree that we collect and store all data you send to or generate through the Service — every message, every uploaded photo, every generated image, every AI prompt and every setting — that our team may review it, and that it is retained indefinitely with no deletion, export or access process available to you. Full detail is in the Privacy Policy, which forms part of these Terms.

Do not send the Service anything confidential, sensitive, or subject to a duty of confidence you owe someone else. Once sent, it cannot be taken back.

10. No support and no contact channel

The Service is unsupported. We do not operate a support desk, a published contact address, a complaints process, or an appeals process for revocations. We are under no obligation to respond to any communication, including messages sent to the bot.

If the Service stops working for you, or your access is revoked, your remedy is to stop using it.

11. Availability and changes

The Service is provided on a best-effort basis with no uptime commitment. We may change, suspend, limit or discontinue any part of it — including features, rate limits, key limits and free access — at any time and without notice. We depend on third-party platforms and AI providers, and a change on their side may degrade or remove functionality without warning.

12. Fees

The Service is free. We may introduce charges in future; if we do, we will say so before any charge applies to you, and you may stop using the Service instead. Nothing here obliges us to continue offering free access, or to offer the Service at all.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DATA WILL NOT BE LOST, OR THAT ANY OUTPUT — INCLUDING IMAGES, EXTRACTED SPECIFICATIONS AND PRICE ESTIMATES — WILL BE ACCURATE, COMPLETE OR SUITABLE FOR ANY PURPOSE.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OR DATA, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED USD 100. The Service is provided free of charge, and that cap reflects it.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of sections 13 and 14 may not apply to you.

15. Indemnity

You will indemnify and hold us harmless against any claim, loss, liability or cost (including reasonable legal fees) arising from your use of the Service, your content, your breach of these Terms, or your infringement of anyone's rights — including any claim brought by a person whose photograph you uploaded.

16. Termination

You may stop using the Service at any time. Stopping does not remove data already collected — see section 9. We may terminate or suspend your access as described in section 4. Sections 7 to 10 and 13 to 17 survive termination.

17. Other terms

• Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
• Changes. We may update these Terms. The current version lives at this URL with the effective date at the top; material changes will be announced through the bot. Continued use after a change means acceptance.
• Severability. If a provision is unenforceable, the rest stays in force.
• No waiver. Not enforcing a provision is not a waiver of it.
• Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets.
• Mandatory local law. Nothing in these Terms removes a protection you hold under a law that applies to you and cannot be waived by agreement.
• No affiliation. We are not affiliated with, endorsed by, or sponsored by WhatsApp, Meta, Telegram or OpenAI.
